Welcome to Automerce, operated by Creative Cube. By using our app and services, you agree to these Terms of Service.

1. Acceptance of Terms

By creating an account or using Automerce, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Description of Service

Automerce provides AI-powered tools for e-commerce sellers to:

• Generate professional product photography backgrounds
• Create marketing copy for product listings
• Publish products to connected e-commerce platforms

3. Account Registration

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to use our services.
• One account per person; shared or duplicate accounts may be terminated.

4. Wallet and Payments

4.1 Wallet System

• Automerce uses a prepaid euro-based wallet system.
• You add funds to your wallet, which are then deducted when you use AI features.
• Wallet funds never expire as long as your account remains active.

4.2 Pricing

Current pricing (subject to change with notice):

• AI Image Generation: Starting at approximately 0.65 per image
• AI Copy Generation: Starting at approximately 0.10 per generation
• Image Regeneration: Starting at approximately 0.50 (after 2 free regenerations per image)
• Store Publishing: Starting at approximately 0.20 per store per product

4.3 Refund Policy

• Wallet Funds: All purchases of wallet funds are final and non-refundable.
• Failed Generations: If AI generation fails due to a technical error on our side, your wallet will be automatically refunded.
• Account Deletion: Any remaining wallet balance is forfeited upon account deletion.
• Exceptional Circumstances: Refunds for exceptional circumstances are considered on a case-by-case basis at our sole discretion.

5. Identity Lock Guarantee

Our AI generates background plates only. Your original product photo is never modified by our AI systems. The product you upload appears exactly as-is in the final generated images.

6. Acceptable Use

You agree NOT to:

• Upload content that infringes on intellectual property rights
• Upload illegal, harmful, or offensive content
• Attempt to circumvent our payment systems
• Use automated tools to access our services without permission
• Share account credentials with third parties
• Reverse engineer or attempt to extract our AI models or algorithms

7. Intellectual Property

7.1 Your Content

You retain ownership of the product photos you upload and the product information you provide.

7.2 Generated Content

AI-generated backgrounds and copy are licensed to you for commercial use in your e-commerce listings. You may not resell generated backgrounds as standalone products.

7.3 Our Service

Automerce, its design, features, and technology are the property of Creative Cube and protected by intellectual property laws.

8. Third-Party Platforms

When you connect e-commerce platforms (WooCommerce, Shopify, Etsy, etc.), you are also bound by their respective terms of service. We are not responsible for issues arising from those platforms.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• That AI-generated content will meet your specific requirements
• Specific sales results from using our generated content

10. Limitation of Liability

To the maximum extent permitted by law, Creative Cube shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

11. Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings. Upon termination:

• Your access to the service will end immediately
• Any remaining wallet balance will be forfeited
• Your data will be deleted in accordance with our Privacy Policy

12. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the European Union and any applicable local laws.
